These Affiliate Program Terms of Service (“Affiliate Terms”) govern your participation as an affiliate partner in the Y'alloha affiliate referral program (the “Program”). By applying to or participating in the Program, you agree to be bound by these Affiliate Terms in addition to the Y'alloha Terms of Service and Privacy Policy.
Y'alloha (“we,” “our,” or “the Platform”) provides a technology platform that connects vacation rental hosts (“Hosts”) with affiliate partners (“Affiliates” or “you”) who promote direct bookings in exchange for commissions. The Platform facilitates tracking, attribution, and communication between Hosts and Affiliates but is not a party to the commission agreement between them.
To participate in the Program, you must:
Each Host may set additional eligibility requirements for their specific program, including affiliate type restrictions and application questions. Acceptance into one Host's program does not guarantee acceptance into another.
You are required to clearly and conspicuously disclose your affiliate relationship in all content where you promote or reference a Host's property. This includes, but is not limited to:
Disclosure must be made using clear language such as “#ad,” “#affiliate,” “#sponsored,” or “I earn a commission if you book through my link.” Disclosures must be visible without requiring the viewer to click, expand, or scroll.
Affiliates shall not:
All content created in connection with the Program must be truthful, not misleading, and must not contain content that is defamatory, obscene, discriminatory, or in violation of any applicable law. You are solely responsible for all content you create or distribute.
Commission rates, basis (nightly rate vs. total booking value), caps, and other terms are set by each Host individually and disclosed to you at the time of application approval. Your specific commission terms are frozen at the time of approval and displayed on your affiliate wallet pass.
Commissions are earned only on confirmed, completed bookings made through your unique referral link or referral code. Attribution is tracked via first-party cookies and URL parameters. The standard attribution window is 30 days from the last click.
Hosts may update commission terms at any time with a minimum of 14 days advance notice. When terms change, you will be notified via email and given the option to accept the new terms or decline. If you decline, your affiliate membership with that Host will be terminated, but any commissions already earned will still be paid on their scheduled dates. If a Host chooses to grandfather existing affiliates, your original terms remain in effect.
Commissions may be voided if: the booking is cancelled by either party, the booking is determined to be fraudulent or a self-referral, or you violate these Affiliate Terms.
Commissions are confirmed after the guest's checkout date plus the Host's specified payout window (typically 7 days). This window allows the Host to confirm the stay was completed and handle any post-checkout disputes.
Payment is processed by the Host directly to you via their chosen payout method (e.g., Venmo, Zelle, PayPal, or check). Y'alloha facilitates tracking and notification but does not process or guarantee affiliate payments. Payment timing and methods are determined by each Host.
You are responsible for any taxes owed on commission income. Y'alloha and Hosts may request tax identification information (e.g., W-9) if required by applicable tax law.
By participating in the Program, you consent to the collection and processing of data related to your affiliate activities, including:
Y'alloha does not sell your personal data to third parties. Data is shared only with the specific Host whose affiliate program you participate in. For more information, see our Privacy Policy.
Either you or the Host may terminate your affiliate relationship at any time, for any reason. Y'alloha may also terminate your participation in the Program if you violate these Affiliate Terms.
Upon termination:
Y'alloha provides the affiliate tracking platform on an “as-is” basis. We do not guarantee uninterrupted service, error-free tracking, or any minimum level of earnings. To the maximum extent permitted by law:
Commission disputes between you and a Host should first be resolved directly between the parties. Y'alloha may, at its sole discretion, provide mediation assistance but is not obligated to do so.
Any dispute arising out of or relating to these Affiliate Terms that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the Commonwealth of Virginia, and the arbitrator's decision shall be final and binding.
Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.
We may update these Affiliate Terms from time to time. Material changes will be communicated via email to active affiliates at least 14 days before taking effect. Continued participation in the Program after the effective date constitutes acceptance of the updated terms. If you do not agree to the changes, you may terminate your participation by contacting us.
